Terms and Conditions

These Terms and Conditions (the "Terms") form a legal agreement between you and RedAlpha Games ("RedAlpha Games", "we", "us" or "our") and govern your access to and use of our mobile games, applications and this website (together, the "Services").

By downloading, installing, accessing or using the Services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Services.

1. Eligibility

The Services are intended for a general audience. You must be at least 13 years old, or the higher minimum age required in your country, in order to use the Services. If you are a minor in your jurisdiction, you may use the Services only with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms. By using the Services, you represent that you meet these requirements.

2. Licence to use

Subject to these Terms, we grant you a limited, personal, nonexclusive, nontransferable, nonsublicensable and revocable licence to download and use the Services on a device that you own or control, solely for your personal and noncommercial entertainment.

You agree that you will not, and will not permit others to:

• copy, modify, translate or create derivative works of the Services;
• reverse engineer, decompile or disassemble any part of the Services, except to the extent that this restriction is prohibited by law;
• rent, lease, lend, sell, sublicense or otherwise commercially exploit the Services;
• remove, obscure or alter any proprietary notices; or
• use cheats, automation software, bots, hacks, modifications or any unauthorised tools that interfere with the Services.

3. Accounts and game data

Our games can generally be played without creating an account. Your progress is stored on your device and may optionally be synced to our servers so that it can be saved or restored. You are responsible for maintaining your device and any backups. We are not responsible for game data that is lost, for example if you uninstall the application, change or reset your device, or disable backups.

4. Virtual items and currency

The Services may include virtual items, virtual currency such as coins, hints, boosts or other digital content (together, "Virtual Items").

• Virtual Items are licensed to you, not sold, and you receive only a limited right to use them within the applicable game.
• Virtual Items have no monetary value, are not real currency, and cannot be redeemed for cash or exchanged for anything of value outside the game.
• Virtual Items are not transferable and are not refundable, except where required by law.
• We may manage, regulate, control, modify or remove Virtual Items at any time, with or without notice, and we will have no liability to you for doing so.
• Any Virtual Items or entitlements are forfeited if your access to a game is terminated or if the game is discontinued.

5. Purchases and refunds

The Services may offer optional purchases, including a permanent option that removes most advertisements and packs of Virtual Items. All purchases are processed by the applicable application store, the Google Play Store or the Apple App Store, and are subject to that store's terms and payment policies. We do not process or store your payment card details.

Prices are shown before you confirm a purchase and may change over time. Once a purchase is completed and the Virtual Items or entitlement are delivered, it is generally final. Refund requests are handled by the application store in accordance with its policy, and any statutory rights that you may have are not affected. The permanent option that removes advertisements is a single, nonconsumable entitlement tied to your application store account.

6. Advertisements

Our free games are supported by advertising and may display banner, interstitial and optional rewarded advertisements provided by third party advertising networks. Rewarded advertisements are optional and grant a reward within the game only if you choose to watch them. You can remove most advertisements by purchasing the option described in Section 5. How advertising data is handled is described in our Privacy Policy.

7. Acceptable use

You agree not to use the Services to:

• violate any applicable law or regulation;
• infringe the intellectual property, privacy or other rights of others;
• gain or attempt to gain unauthorised access to the Services, to other users' data, or to our systems;
• distribute malware, or disrupt, overload or impair the Services;
• exploit defects, use unauthorised tools, or otherwise gain an unfair advantage; or
• harass, abuse or harm another person, or engage in any fraudulent activity.

8. Intellectual property

The Services, including all games, software, code, artwork, graphics, audio, text, logos, trademarks and other content, are owned by RedAlpha Games or by our licensors, and are protected by intellectual property laws. Except for the limited licence granted in these Terms, no rights are transferred to you. The RedAlpha Games name and logo, and the names and logos of our games, are trademarks of RedAlpha Games. All rights that are not expressly granted are reserved.

9. Feedback

If you send us ideas, suggestions or feedback about the Services, you grant us a perpetual, irrevocable, worldwide and royalty free licence to use and incorporate that feedback for any purpose, without any obligation or compensation to you.

10. Third party services

The Services rely on and work together with services and platforms provided by third parties, such as the application stores, Google, and their advertising and infrastructure services. Your use of those services is governed by their own terms and policies. We are not responsible for third party services, and your dealings with them are solely between you and the third party.

11. Updates and availability

We may update, modify, suspend or discontinue any part of the Services at any time, with or without notice. We may also require you to install updates in order to continue using a game. We do not guarantee that the Services will always be available, uninterrupted or free of errors.

12. Disclaimers

To the maximum extent permitted by law, the Services are provided as is and as available, without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, title and noninfringement. We do not warrant that the Services will meet your requirements, be secure, or be free of defects, viruses or errors. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

13. Limitation of liability

To the maximum extent permitted by law, RedAlpha Games and its affiliates, officers, employees and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, data, goodwill or other intangible losses, arising out of or relating to your use of, or your inability to use, the Services.

To the maximum extent permitted by law, our total aggregate liability for all claims relating to the Services will not exceed the greater of (a) the amount that you paid to us, if any, for the Services in the twelve months before the event giving rise to the claim, or (b) fifty United States dollars. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you, and nothing in these Terms limits liability that cannot be limited by law.

14. Indemnification

You agree to indemnify and hold harmless RedAlpha Games and its affiliates from and against any claims, damages, losses, liabilities and expenses, including reasonable legal fees, arising out of or related to your misuse of the Services, your violation of these Terms, or your violation of any rights of a third party.

15. Termination

These Terms remain in effect while you use the Services. We may suspend or terminate your access at any time, with or without notice, if we believe that you have violated these Terms, or in order to protect the Services or other users. You may stop using the Services at any time by uninstalling the application. Sections that by their nature should survive termination, including Sections 4, 8, 9, 12 to 14 and 16, will survive.

16. Governing law and disputes

These Terms are governed by the laws of India, without regard to its conflict of laws rules. Subject to applicable law, the courts located in India will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services, and you consent to their jurisdiction. Nothing in this section affects any mandatory consumer protection rights that are available to you in your country of residence.

17. Changes to these Terms

We may revise these Terms from time to time. When we do, we will update the date shown at the top of this page and, where appropriate, provide additional notice. Changes take effect when they are posted. Your continued use of the Services after changes take effect means that you accept the revised Terms.

18. General

• Entire agreement. These Terms and the Privacy Policy form the entire agreement between you and RedAlpha Games regarding the Services.
• Severability. If any provision is found to be unenforceable, the remaining provisions will remain in full effect.
• No waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.
• Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition or sale of assets.
